The following terms and conditions apply to all orders for the purchase of goods from The Clear Out Online Store.
Please print a copy of these terms and conditions for your future reference.
If you place an order online to purchase an item from The Clear Out we will send you an e-mail confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase an item or items which is accepted by us when we deliver the product to you. Any products on the same order which we have not delivered to you do not form part of that contract. You warrant that you are legally capable of entering into binding contracts and that you are at least 18 years old.
Description of the Goods
We will take all reasonable care to ensure that all details, descriptions and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. We reserve the right to refuse orders where product information has been mis-published, including prices and promotions.
The supply of goods from this website is subject to availability and it is not always possible for us to inform you at the time you place your order whether the goods you want are still available for purchase. In the case of this happening a carefully selected alternative may be sent, or a refund may be given.
We only deliver inside the UK at this time.
All items are usually delivered within 1-10 working days of being purchased. This excludes weekends and Bank Holidays.
All our items are wrapped in white tissue paper, secured with a sticky label before being packaged into a postage bag or box.
Please note: we use reused, recycled, biodegradable and recyclable packaging where possible.
Our Economy delivery charge is £3.49 (3-5 working days) and our Standard delivery charge is £3.99 (2-4 working days) and our Fast delivery charge is £4.99 (1-3 working days) Eco Plus Delivery only available at certain times of the year.
these are sent tracked by Royal Mail 2nd Class/1st Class, DPD or Evri (depending on size of parcel or choice at checkout) to your desired address.
(In some cases delivery can be quicker than our stated time frames and in rare occasions slightly later due to postal delays out side of our control.)
Cancellation and Returns
We offer a 14 day no quibbles returns policy which begins from the date you received the goods. You have 14 days from receipt of your item to notify us you wish to return it, then have 7 days from receiving your return label to return the item. If you contact us outside of the 14-day period or fail to return the item to us within the time stated we will not refund the order (unless defective/damaged). All unwanted goods should be returned in their original condition. (at time of receipt) This does not affect your statutory rights. When issuing a refund for faulty items we will refund the full price of the goods, including any mandatory delivery charges incurred. If your order included more than one item, you will only receive a refund of the delivery cost if you return all items within that order
You will receive notification via e-mail of your refund. You can expect a refund in the same form of payment originally used for purchase.

When taking advantage of our 3 for 2 offers, the cheapest item is free. The free item can not be refunded or exchanged.
All credit and debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

All PayPal orders are charged when we despatch your items. We’re sorry but, for security reasons, we do not offer PayPal as a method of payment for exchange orders.
All reasonable measures are taken by us to ensure that this Online Store is operational all day, every day. However, occasionally technical issues may result in some downtime and accordingly we will not be liable if this website is unavailable at any time. Where possible we always try to give advance warning of maintenance issues that may result in website down time but we shall not be obliged to provide such notice.
Alteration of Service or Amendments to the Conditions
We revise our Terms and Conditions from time to time to reflect changes to the way we do business, changes in market conditions affecting our business, changes in technology, changes in payment methods, changes in relevant laws and regulatory requirements and changes in our systems capabilities. You will be subject to the Terms and Conditions in force at the time that you place an order with us, unless we notify you of the change to these Terms and Conditions before we send you the Order Confirmation (in which case we will assume that you have accepted the change to the Terms and Conditions, unless you notify us to the contrary prior to sending the Items to us).
Whilst we do take all reasonable steps to make sure that the information on this website is up to date and accurate at all times we do not guarantee that all material is accurate and, or up to date.
All our items of clothing are checked by our team before being uploaded on to our online store. We deem all items sold to be fit for use and in good condition. (No holes, stains or severe defects unless stated in the description) Some items may have signs of wear and although we do our utmost to accurately show the condition of all clothing in our photos, some items may have previous owners names inside, (These will not be shown in our pictures) although we do our best to remove these where possible.
Due to difference in computer sceens, colours may vary slightly from pictures.
Although we wash all used clothing before uploading to our online store, we do advise our customers to re-wash before use: a) to avoid any adverse affects from our laundry detergents that may not be suitable for certain skin conditions. b) some items may have been stored for some time in between being washed and then sold. Therefore may not be as fresh as when they were originally uploaded to our site.
We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss even if the loss was reasonably foreseeable to both you and us when you commenced using the website or when the contract for the sale of goods was formed. However, this does not limit liability for death or personal injury caused by negligence which cannot be excluded or under the law of the United Kingdom.
Governing law and jurisdiction
These terms and conditions are governed by the laws of England and Wales. You agree, as we do, to submit to the exclusive jurisdiction of the English courts.￼
